Expats can work under local wife's sponsorship

The UAE government, on a recommendation from the Ministry of Labour and Social Affairs, has allowed the expatriate men married to national women to work in the country while being on their wife's sponsorship and without having to transfer their sponsorship on the companies employing them.

A labour card will be issued to the foreigner sponsored by his local wife who married upon a special permission from the President, His Highness Sheikh Zayed bin Sultan Al Nahyan, as per a law regulating the marriage of UAE women to expatriates.

The UAE laws and regulations prevent expatriates holders of residence visas sponsored by relatives or spouses from working in the country. However, a Cabinet Order No 149/2 issued in 1983 exempted expatriate women sponsored by their relatives from this rule and allowed them to work after obtaining a labour card from the ministry.

In the light of the increasing number of expatriate men staying in the country on their UAE national wives' visas, and who had been seeking permissions to work for different companies, the Higher Labour Committee of the ministry, earlier this year submitted a proposal to the UAE Cabinet suggesting adding foreign husbands of local women to the categories exempted from the rule that bans holders of residence visas from working in the country. The Cabinet had recently issued an order authorising the ministry to issue labour cards for foreigners on local wives' visas.

Based on this order, Dr. Khalid Al Khazraji, the ministry's Under Secretary for Labour Affairs issued on Monday an administrative order detailing the procedures and requirements for issuing labour cards to this category. Unlike the labour card issued for the expatriate woman on her husband's visa which is valid for one- renewable year, the labour cards for foreign men sponsored by UAE national wives, will be issued for three years and will cost Dh 1,200.

The administrative order instructs the employment licensing departments in Abu Dhabi and Dubai, as well as the labour offices across the country to issue the labour cards and contracts for this category after ensuring that all requirements were met. Among the required papers an attested marriage contract, photocopies of wife and husband's passports, valid residence visa and educational certificate for the husband. (The Khaleej Times)
